The types of information that we collect fall under two general categories: personally identifiable information (“PII”) and non-personally identifiable information (“non-PII”). PII consists of any information which can be used to specifically identify you as an individual, whereas non-PII consists of aggregate information or any information that does not reveal your identity. The following sections describe how your PII and non-PII are collected by us, and how we use such information..
When you use the Services to purchase digital downloads or shippable items, we require you to register with us by connecting with your Facebook account. In addition, we require you to provide us with payment information, including your name, address, email address, credit or debit card number, and credit or debit card verification code, which we (and our payment processor) use to process your transaction. We will store your email address in our database, and we may use your email address as described below under “Via Other Methods” (such as to send you a receipt for your transaction, or to contact you if there is a problem with your order). We will also share your email address with the Artist if you opt-in to such sharing. We do not keep any of your payment information on file.
If you do not want to receive marketing communications from an Artist, you may opt out of such emails by following the directions included in such emails. We require each Artist to agree that they will not disclose, rent or sell your PII and they will use your PII only in ways that are permitted by law, but we have no control over how Artists use your PII.
When you register with us to use the Services, you are required to provide us with contact and payment information, including your name, address, email address, and a valid PayPal account number.
We use your email address for both transactional (e.g., to send you receipts for payments you make to us) and promotional (e.g., newsletters, new product offerings, event notifications, special third-party offers) purposes. Email messages we send you may contain code that enables our database to track your usage of the emails, including whether the email was opened and what links (if any) were clicked. If you would rather not receive promotional emails from us, please see the section below labeled “Choice/Opt-Out”. We reserve the right to send you certain communications, such as service announcements and administrative messages, without offering you the opportunity to opt out of receiving them.
We track usage of the Services on our servers through log files. We may use this information in order to administer the Services, prevent fraud, track visitor movement in the aggregate, and gather broad demographic information that is non-PII (such as your IP addresses, browser type, Internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks).
We may use web beacons (also known as “clear GIFs”) to track, target and better understand how you use the Services. Web beacons are small transparent graphic images that are used to collect a limited set of information. We may also use web beacons in email communications in order to track the effectiveness of our email marketing. We do not link web beacons to any PII.
We store the information we collect through log files, cookies, and web beacons in a profile containing each user’s viewing preferences. We use this information in order to identify your interests and improve the content provided by the Services.
We may periodically conduct voluntary surveys. We encourage our users to participate in such surveys because they provide us with important information regarding the improvement of the Services. You may also volunteer for certain surveys that we may offer to our users, and any additional rules regarding the conduct of such surveys will be disclosed to you prior to your participation. We might share demographic information with a partner or advertiser, but we will not link the survey responses to any PII, and all responses will be anonymous.
We may provide a referral service to enable you to tell a friend about our Services, in which case we will ask you for your friend’s name and email address and then send your friend a one-time email inviting him or her to try our Services. We will store that information for the sole purpose of sending that one-time email and tracking the success of the referral service. Your friend may email us at firstname.lastname@example.org to request that we remove this information from our database.
We may disclose information you provide (including your PII) if required to do so by law, at the request of a third party, or if we, in our sole discretion, believe that disclosure is reasonable to (1) comply with the law, requests or orders from law enforcement, or any legal process (whether or not such disclosure is required by applicable law); (2) protect or defend the rights or property of us or a third party; or (3) protect someone’s health or safety.
We may share your non-PII with third parties, but not in a manner that would reveal your identity. We may share your PII, sometimes in conjunction with your non-PII, with service providers that may be associated with us to perform functions on our behalf. For example, outsourced customer support agents or technology infrastructure providers may need access to your information to perform services for you on our behalf (such as processing payments you make or hosting part of the Services). Your information will be treated as private and confidential by such service providers and not used for any other purpose than we authorize. In addition, from time to time, we may share PII (such as email addresses) about our user base with carefully selected third parties, so they can offer goods and services that we believe may be of interest to our users. If you do not wish to receive offers from our trusted partners, you can change your email preferences at any time by following the steps outlined in the “Choice/Opt-Out” section below.
As we develop our business, we may sell assets or merge, consolidate or combine with another party and, depending on the transaction, your PII may be transferred to the acquiring party. If any of these things occur, you will be notified if there are any material changes to the way your PII is collected or used.
We may use third-party advertising agencies or other service providers to serve ads on the Services. These companies may employ cookies and web beacons to measure advertising effectiveness. Any information that these third parties collect via cookies and web beacons will be completely anonymous. Some of these third-party advertising agencies may be members of the Network Advertising Initiative, which offers you the option to opt out of ad targeting from its member agencies by following the procedures listed at http://www.networkadvertising.org/managing/opt_out.asp.
Age restrictions for the Services are set forth in our Terms. We do not target our Services to children under the age of 13, and in compliance with the Children’s Online Privacy Protection Act, any information we may receive from users we believe to be under the age of 13 will be purged from our database. If you believe that we might have any information from or about a child under age 13, please contact us at email@example.com.
We have security measures in place to protect the loss, misuse and alteration of the information stored in our database. We will exercise reasonable care in providing secure transmission of information between your computer and our servers, but given that no information transmitted over the Internet can be guaranteed 100% secure, we cannot ensure or warrant the security of any information transmitted to us over the Internet and hence accept no liability for any unintentional disclosure. When you enter payment information (such as your credit card number), we (or our payment processor) encrypt that information using secure socket layer technology (SSL).
The Services may contain links to third party websites. However, we do not control or take any responsibility for the privacy practices of, or information collected by, any third parties, including any affiliated or co-branded websites which link to the Services or advertise on the Services.
You may use the following options for removing your information from our email database if you wish to opt out of receiving promotional emails and newsletters:
click on the “unsubscribe” link on the bottom of the email; or
send us an email us at firstname.lastname@example.org to request that we remove your information from our database.
If you are an Artist, you may modify or delete any of your account information at any time through the settings page in your account accessible via a link from the home page on our SonicRow.com website. If you are a User, you may request that we modify or delete any of your account information at any time by emailing us at email@example.com.
California customers may request further information about our compliance with this law by emailing firstname.lastname@example.org. Please note that Sonic Row is only required to respond to one request per customer each year and not required to respond to requests made by means other than through this email address.
